BEFORE: WEICK, LIVELY and JONES, Circuit Judges. Order Nan Marie Neale appeals from the judgment of the district court denying her application for a writ of habeas corpus because she is not ""in custody in violation of the Constitution... of the United States"" within the meaning of 28 U.S.C.Â§ 2241(c)(3). Neale also petitions this Court for an original writ of habeas corpus pursuant to 28 U.S.C. Â§ 2241(a) et seq. and Fed. R. App. P. 22. Because we believe that the district court properly found that Neale was not ""in custody"" under the federal habeas corpus statute and because we find no merit in Neale's petition for an original writ, we affirm the judgment of the district court and we deny the petition for an original writ.
